There are several reasons you might receive an overpayment from Social Security. It isn't always clear which benefits you are entitled to. A social security attorney can help you understand which social security benefits you should be receiving. If you are not filing a joint petition and requesting a waiver, check any one of the remaining options.

The basic Social Security benefits application (OMB No. 0960-0618) contains a lead question asking if the applicants are qualified (or will qualify) to receive a government pension. Many children with disabilities under the age of 18 do not receive SSI because of rules that cause the income and resources of the custodial parents to be deemed to belong to the child.

The first thing Social security wants you to do is pay the overpayment back. If the disagreement is over SSI case, the person requesting reconsideration should also request different ways to handle the appeal. Take your binder with you whenever you go to a Social Security office, and take notes in it every time you communicate with Social Security.

Jan Dils, Attorneys at Law, handles personal injury, Social Security disability and veterans' disability claims for clients throughout West Virginia, with offices in Parkersburg, Beckley, Charleston, Huntington, Logan, as well as one additional office in Charlotte, North Carolina.

For Social Security recipients, expect the SSA to withhold your entire benefit check until the repayment is completed. Question 5 requires an explanation for why you believed you were receiving the overpaid money, along with a reason you weren't at fault for the overpayment.

If you were overpaid because of a return to work and you didn't bother telling Social Security, it will be difficult to generate much sympathy. Read the letter and note the time period that the letter states an overpayment occurred and the amount. Rather, a Statement of Claimant Form or a simple letter written requesting a waiver should suffice.

If you are currently receiving SSDI checks and you don't make a full refund, the SSA will stop your checks (that is, withhold the entire amount of your check) until the overpayment is paid off. The SSA-632 and SSA-632-bk are the Social Security forms are used for that.

The SSA can collect monies from any future federal tax return you are supposed to receive or withhold money from your Social Security retirement benefits when you retire and try to claim benefits (or, of course, from future disability benefits if you qualify for disability again).

As part of that application, the applicant or the applicant's representative payee (the person or entity designated by the SSA to receive the SSI benefit on behalf holistic marketing concept of the applicant) confirms that he or she will report any change in circumstance to the SSA that would impact the SSI benefit payment.

Be warned Social Security can be slow and time lags can be hair pulling. There is equivalent information, in writing and over the individual's signature (or that of his or her representative payee, legal counsel, or other appointed representative), is in the file.
